These Terms of Service constitute a legally binding agreement made between you and AIRNOSS FLIGHT TRAINING, LLC ("Company," "we," "us," or "our"), concerning your access to and use of the website www.airnoss.com (the "Site") as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto.
By accessing the Site, you agree that you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Site and you must discontinue use immediately.
We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms of Service, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Service to stay informed of updates.
AirNoss Flight Training, LLC provides flight training, aircraft management, aircraft sales, and related aviation services. Our services include, but are not limited to, discovery flights, private pilot training, instrument rating training, commercial pilot training, flight instructor certification, SIM membership access, Cirrus transition training, and aircraft management for owners of all makes and models.
All flight training services are conducted under the regulations set forth by the Federal Aviation Administration (FAA). AirNoss is a Cirrus Authorized Training Center based at Guthrie Edmond Regional Airport (KGOK), Guthrie, Oklahoma.
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights.
The Content and Marks are provided on the Site "AS IS" for your information and personal use only. Except as expressly provided in these Terms of Service, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
By using the Site, you represent and warrant that:
Flight training sessions, discovery flights, and SIM sessions are scheduled through our online booking system or by contacting AirNoss directly. All scheduled sessions are subject to weather conditions, aircraft availability, and instructor availability.
We reserve the right to cancel or reschedule any session due to weather, maintenance, or safety concerns at no penalty to the student. Students who wish to cancel or reschedule should provide at least 24 hours notice. Failure to provide adequate notice may result in a cancellation fee.
You acknowledge that aviation activities, including flight training, discovery flights, and simulator sessions, involve inherent risks. By participating in any AirNoss service, you voluntarily assume all risks associated with such activities, including but not limited to the risk of injury, illness, or death.
AirNoss carries appropriate insurance coverage and adheres to all FAA safety standards. All training aircraft are equipped with the Cirrus Airframe Parachute System (CAPS) for additional safety.
Payment for services is due at the time of service unless otherwise agreed upon in writing. We accept major credit cards and other payment methods as listed on our website. All fees are non-refundable unless otherwise stated or required by law.
Flight training costs are estimates based on FAA minimums and average completion times. Actual costs may vary based on individual student proficiency, weather delays, and scheduling frequency. Our cost calculator provides estimates only and does not constitute a guarantee of total training cost.
In no event will the Company, its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site or services, even if we have been advised of the possibility of such damages.
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of your use of the Site or breach of these Terms of Service.
The Site may contain links to third party websites or services that are not owned or controlled by AirNoss. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party websites or services. This includes, but is not limited to, Cirrus Aircraft, Cirrus Approach, Calendly, and any financing partners.
These Terms shall be governed by and defined following the laws of the State of Oklahoma. AirNoss Flight Training, LLC and yourself irrevocably consent that the courts of Logan County, Oklahoma shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Terms.
Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall first be attempted to be resolved through informal negotiation. If the dispute is not resolved within thirty (30) days of written notice, either party may proceed with formal legal action in the appropriate court of jurisdiction.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
These Terms of Service, together with the Privacy Policy and any other legal notices published by us on the Site, constitute the entire agreement between you and AirNoss Flight Training, LLC regarding your use of the Site.
